The Ministry of Tourism, Posts and Telecommunications has the basic function of carrying out general governmental duties and the development of the tourism, posts and telecommunications sector as well as regulatory functions over those sector, and the supervision and guidance over the efficiency and effectiveness of the State Owned Companies under the auspices of the Ministry of Tourism, Posts and Telecommunications; of which the permanent procedures for Supervision and Guidance by the Secretary General, the Inspector General and the Director General were established pursuant to the Decree of the Minister of Tourism, Posts and Telecommunications No. KM. 54/PS. 102/MPPT-92 dated August 20, 1992.
The Directorate General of Posts and Telecommunications has functions to formulate technical policy, to grant license and permission, and to execute the establishment of posts and telecommunications in accordance with its duties as well as to impose technical safety measures for the execution of the Directorate General's main duties.
In practical the general policies established by the Ministry of Tourism, Posts and Telecommunications were translated into operational policies by the Directorate General of Posts and Telecommunications.
Amongst other Bureaus, the Bureau most responsible for day-to-day activities related to regulatory matters is the Law and Organization Bureau which is responsible for the preparation of the drafts and dissemination of Ministerial Decrees as well as proposing input Presidential Decrees. This Bureau also acts as the Coordinator in the preparation of drafts for new laws related to tourism, posts and telecommunications affairs.
The Secretariat of the Directorate General is responsible for day-to-day work on general affairs.
Operational policies on telecommunications related to planning, construction and operational aspects are under the responsibility of the Directorate of Telecommunications.
The Directorate of Standardization is responsible for coordination of the provision of any standard and recommendation related to telecommunications system. In addition, telecommunications issues in relation with international organizations such as the ITU, APT, GATT, UNCOPUOS, INTELSAT and INMARSAT are also under the responsibility of the Directorate of Standardization.
The Directorate of Frequency is responsible for the coordination on the use of radio frequency spectrum, which includes frequency management, frequency monitoring, licensing, inter-system coordination, interfacing with the International Frequency Registration Board of the ITU. In addition, issues related to the ITU Radio Regulation and the various Radio Conferences within the ITU are also coordinated by the Directorate of Frequency.
The current number of employees employed in the Directorate General of Posts and Telecommunication is around 500 persons.
There are a number of government authorities involved in the process of establishing telecommunications law and policy such as the Ministry of Tourism, Posts and Telecommunications including the Directorate General of Posts and Telecommunications, the Secretariat of the Cabinet, the House of Representatives and other related Departments.
The House of Representatives
The establishment of the House of Representatives and its rights are indicated in the 1945 Constitution. The structure of the House of Representatives is defined by the law. The House shall hold its meeting at least once a year.
Any law to be enacted shall be approved by the House. If the draft of law has not been approved by the House, the draft is not allowed for resubmission at the Meeting of the House for such period. Members of the House have the right to submit drafts of law.
in the case that a draft, even though have been granted approval by the House, is not approved by the President of the Republic of Indonesia, then the draft shall not be allowed for submission at the meeting of the House for such period.
in the case of emergency, the President of the Republic of Indonesia has the right to issue a Government Regulation as a substitution of law. This Government Regulation shall be subject for approval by the House at its next meeting. If the approval is not granted, the Government Regulation shall be repealed.
The Cabinet Secretariat
One of the Secretariat's functions is to receive draft proposals on new laws, Presidential Decrees or Government Regulations. After the receipt of draft policies on telecommunications matters, the Secretariat reviews, revises and modifies such draft policies together with the Ministry of Tourism, Posts and Telecommunications. In the case of Telecommunications Law, the Cabinet Secretariat reports to the President of the Republic of Indonesia upon completion of the aforementioned process. Further submission to the House of Representatives will follow for final approval.
The Ministry of Tourism, Posts and Teleconununications
The process of preparing, formulating, reviewing, and finalizing of draft proposals until the dissemination of law and policies on telecommunications is carried out by the Ministry of Tourism, Posts and Telecommunications.
Other Related Ministries
Sometime the process of launching new laws and policies on telecommunications requires the involvement of various related Ministries such as the Ministry of Transportation, Ministry of Defense, Ministry of Information, ministry of Finance, Ministry of Foreign Affairs, etc.
Separate functions have been defined between regulatory bodies and telecommunications operators. The regulatory bodies are responsible for the regulation of the telecommunications industry while the telecommunications operators shall follow the regulation enforced by the regulatory bodies.
A number of meetings are regularly held between the Ministry of Tourism, Posts and Telecommunications and the House of Representatives, normally twice or three times a year dependent upon the requirement to review the current condition of telecommunications as well as future plans. This forum would be a formal process to permit the view of users, consumer groups and others voiced by the members of the House of Representatives in the development of policies.
Informal process, which accommodates public opinions, may also be established in developing policies on telecommunications through direct discussions between the Secretary General and the public represented by its associations.
The views of foreign firms are also considered in developing policies, particularly ones related to the policies on the Telecommunication facilities such as choice of technologies/systems, specifications, technical plan, development plan, etc.
